Introduction

These Terms of Service ("Terms") govern your use of the services provided by Cash Trader, a trading name of CONTIWES GENERAL SALES (CIPC Enterprise Number B2000031518), located at Shop 7, 118 Marone Building, 118 Marone Street, Burgersfort, Limpopo 1150, South Africa.

By purchasing goods, pawning items, or otherwise engaging with our business, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

1. About Cash Trader

Cash Trader operates as a general trading and pawnbroking business, offering:

  • New and used tools and machinery
  • Household goods and everyday items
  • Pawnbroking services (pawn, buy, and sell)

We are committed to fair pricing, transparent service, and compliance with all applicable South African laws and regulations, including the National Credit Act and pawnbroking regulations.

2. General Trading Terms

2.1 Purchase of Goods

  • All prices are displayed in South African Rand (ZAR) and are subject to change without notice.
  • Goods are sold on a first-come, first-served basis, subject to availability.
  • Payment is due at the time of purchase. We accept cash and other forms of payment as displayed in-store.
  • Receipts are provided for all transactions and should be retained for your records.

2.2 Condition of Goods

  • New Goods: Sold with any applicable manufacturer's warranty (if available). We will assist with warranty claims where possible.
  • Used Goods: Sold "as is" unless otherwise stated. We inspect and describe the condition of used items honestly, but used goods may have wear and tear consistent with prior use.
  • Inspection: Customers are encouraged to inspect items before purchase. If you have questions about an item's condition, please ask a staff member.

2.3 Returns and Refunds

  • Due to the nature of our business (including used goods and pawn merchandise), returns and refunds are handled on a case-by-case basis.
  • New goods may be eligible for return or exchange within 7 days of purchase if unused and in original packaging, at the discretion of management.
  • Used goods are typically sold "as is" and are not eligible for return unless an item is materially misrepresented.
  • Refunds, if granted, will be issued in the same form as the original payment.
  • We comply with the Consumer Protection Act (CPA) where applicable. If you believe your consumer rights have been violated, please contact us to resolve the matter.

3. Pawnbroking Terms

Cash Trader operates as a pawnbroker in compliance with South African pawnbroking regulations, including the National Credit Act (NCA) and related legislation.

3.1 Pawning an Item

  • You must be at least 18 years of age and provide valid identification (South African ID, driver's license, or passport) to pawn an item.
  • You confirm that you are the legal owner of the item being pawned and that it is not stolen, encumbered, or subject to any third-party claims.
  • We will assess the item and offer a loan amount based on its condition, market value, and our internal policies.
  • If you accept the offer, you will receive cash immediately and a pawn ticket detailing the loan amount, interest rate, repayment terms, and redemption deadline.
  • The pawn ticket is your receipt and proof of transaction. Keep it safe — you will need it to reclaim your item.

3.2 Loan Terms and Interest

  • Loan terms, interest rates, and fees will be clearly stated on your pawn ticket at the time of the transaction.
  • Interest is calculated in accordance with the National Credit Act and applicable regulations.
  • You have the right to repay the loan early without penalty.
  • If you need more time to repay, you may be able to extend the loan term by paying the accrued interest and any applicable fees. Extensions are subject to approval and must be arranged before the redemption deadline.

3.3 Redeeming Your Item

  • To reclaim your pawned item, you must present your pawn ticket and repay the full loan amount plus accrued interest and any fees by the redemption deadline.
  • If you lose your pawn ticket, contact us immediately. We may require additional identification and verification before releasing your item.
  • Items must be redeemed within the agreed timeframe. Late redemptions may be subject to additional fees or may not be possible if the item has been sold.

3.4 Unredeemed Items

  • If you do not redeem your item by the deadline (and have not arranged an extension), we have the right to sell the item to recover the loan amount and costs.
  • We will make reasonable efforts to contact you before selling unredeemed items, but it is your responsibility to track redemption deadlines.
  • If the item is sold for more than the outstanding loan amount and costs, any surplus may be returned to you, subject to applicable laws and administrative fees.

3.5 Buying Items Outright

  • If you prefer to sell an item outright rather than pawn it, we may make a purchase offer based on the item's condition and market value.
  • Once you accept the offer and receive payment, the transaction is final, and the item becomes our property.
  • You confirm that you are the legal owner and have the right to sell the item.

3.6 Prohibited Items

  • We do not accept stolen goods, counterfeit items, illegal substances, weapons (unless legally permitted), or items that violate South African law.
  • We reserve the right to refuse any item at our discretion.
  • If we suspect an item is stolen or illegal, we will report it to the appropriate authorities and cooperate fully with law enforcement.

4. Customer Responsibilities

  • Honesty: You must provide accurate information and represent items truthfully (ownership, condition, etc.).
  • Identification: You must provide valid ID for pawn transactions and certain purchases, as required by law.
  • Compliance: You must comply with these Terms and all applicable laws.
  • Respect: You must treat our staff and premises with respect. We reserve the right to refuse service to anyone who is abusive, threatening, or disruptive.

5. Limitation of Liability

  • Cash Trader is not liable for any indirect, incidental, or consequential damages arising from the use of our services or goods purchased from us.
  • Used goods are sold "as is," and we make no warranties beyond those required by law.
  • Our liability for any claim related to goods or services is limited to the purchase price of the item or service in question.
  • We are not responsible for items lost, damaged, or stolen while not in our possession (e.g., after purchase or redemption).

6. Storage and Care of Pawned Items

  • We will take reasonable care to store pawned items securely and protect them from damage.
  • However, we are not liable for loss or damage caused by fire, theft, natural disasters, or other events beyond our reasonable control.
  • We recommend that you insure valuable items separately if concerned about loss or damage.

7. Privacy and Data Protection

  • We collect and use your personal information in accordance with our Privacy Policy and the Protection of Personal Information Act (POPIA).
  • By using our services, you consent to the collection, use, and storage of your information as described in our Privacy Policy.

8. Intellectual Property

  • All content on this website, including text, images, logos, and design, is the property of Cash Trader (CONTIWES GENERAL SALES) or used with permission.
  • You may not reproduce, distribute, or use our content without prior written permission.

9. Changes to Terms

  • We may update these Terms from time to time to reflect changes in our business practices or legal requirements.
  • Updated Terms will be posted on this website with a new "Last Updated" date.
  • Continued use of our services after changes constitutes acceptance of the updated Terms.

10. Governing Law and Dispute Resolution

12. Severability

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cash Trader regarding the use of our services, superseding any prior agreements or understandings.
